BT- FreshCo Check-Out Challenge Contest
1.Contest Period (“Contest Period”) starts at 5:30am on Thursday, May 2, 2013 and continues until Tuesday, May 28, 2013 at 11:59:59 am the Contest Closing Date (the “Contest Closing Date”). All times are Eastern Daylight Savings Time. No purchase necessary. Only one (1) entry per person/per email address per week. Any attempt or suspected attempt to enter more than once per person, any use of robotic, automatic, programmed or entry methods not authorized by these rules, shall be deemed as tampering and will void all of your entries. This contest is brought to you by Rogers Broadcasting Limited, owner of City (“City”), and Sobeys Capital Incorporated operating a grocery store banner called FreshCo. (“Sobeys”), (hereinafter collectively referred to as the “Contest Sponsors”).
2.To enter, go to BreakfastTelevision.ca and follow the Contest link to the BT-FreshCo Check-Out Challenge contest page during the Weekly Entry Period Start Dates and Weekly Entry Period Deadline Dates set out in Section 6 below, complete the entry ballot in full including the correct on sale price featured in the weekly FreshCo ads and on the contest site, and submit it as instructed by the Contest Closing Dates. There is a limit of one (1) entry per person/per email address/per household is permitted during each week of the contest period. If it is discovered that any person has attempted to: (i) obtain more than one (1) entry per person/per email address/per household per week; and/or (ii) use (or attempt to use) multiple names, identities and/or more than one (1) email address to enter the Contest; then (in the sole and absolute discretion of the Contest Sponsors) he/she may be disqualified from the Contest.
3.Three (3) random draws will be made each week for four (4) weeks on the weekly entrant draw date by a representative of City, from all eligible entries received as of the weekly entry period deadline dates, at Toronto, Ontario and the three (3) selected entrants each week will each be a finalist (“Finalist”) to participate in the BT-FreshCo Check-Out Challenge for which they entered. Non-selected entries do not carry over to the next weekly draw period. The selected entrants will be contacted by telephone or email, as set out on their entry. The selected entrant must be available upon first contact or a new selected entrant will be drawn from all eligible entries received. Odds of becoming a Finalist depend on the number of eligible entries received during the applicable weekly entry periods.
4.All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by the Contest Sponsors. The Contest Sponsors take no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. The Contest Sponsors are not responsible for any errors or omissions in printing or advertising this Contest. All entries become the property of the Contest Sponsors and will not be returned.
5.There are a total of four (4) Grand Prizes of two thousand dollars ($2000.00 CDN) FreshCo gift cards (each a “Grand Prize”) and eight (8) runner-up prizes of five hundred dollars ($500.00 CDN) FreshCo gift cards (each a “Runner-up Prize”) available to be won at the outset of the Contest. One Grand Prize and two Runner-up prizes will be awarded weekly in accordance with the table at Section 6 below. Odds of winning the Grand Prize each week are 1:3. Limit of one Prize per eligible entrant. All taxes and other costs not expressly covered by the Sponsor are the responsibility of the individual winner.
6.The weekly entry periods for each of the weekly draw periods are specified in the following table:

7.If a selected entrant cannot be reached within first contact following the draw, incorrectly answers the skill-testing question, declines the prize, or fails to return a release of liability as specified below, the selected entrant will be disqualified and forfeits the prize and another entrant will be selected until the prize is awarded. If the selected entrant is unable to attend the Breakfast Television broadcast date, as designated below, they will forfeit the opportunity to win the grand prize or the runner-up prizes and another eligible entry will be selected, from all eligible entries received. Transportation, hotel accommodations and any other expenses incurred to get to and participate in the Breakfast Television competitions are at the selected entrants’ expense and will not be provided by the Contest Sponsors.
8.Finalists will appear on Breakfast Television Toronto where they will compete on-air for a chance to win either a Grand Prize of a two thousand dollar ($2,000) FreshCo gift card or a Runner-up Prize of a five hundred dollar ($500) FreshCo gift card as described in Section 5 herein.
a)Week One selected entrants must be available to travel to Toronto and appear on a live broadcast of Breakfast Television between 6am and 9am on Thursday, May 9, 2013 to play the game.
b)Week Two selected entrants must be available to travel to Toronto and appear on a live broadcast of Breakfast Television between 6am and 9am on Thursday, May 16, 2013 to play the game.
c)Week Three selected entrants must be available to travel to Toronto and appear on a live broadcast of Breakfast Television between 6am and 9am on Thursday, May 23, 2013 to play the game.
d)Week Four selected entrants must be available to travel to Toronto and appear on a live broadcast of Breakfast Television between 6am and 9am on Thursday, May 30, 2013 to play the game.
9. The Contest Sponsors reserve the right, in their sole discretion to substitute a prize of greater or equal value in the event of the unavailability, for whatever reason, of the advertised prize in whole or in part.
10.Prizes are not transferable, convertible to cash, refundable, sold, exchanged, substitutable for any other kind of prize and must be accepted as awarded, except at the sole and absolute discretion of the Contest Sponsors. Please allow four (4) to six (6) weeks for Grand Prize delivery/fulfillment. Contest Sponsors will not replace any lost or stolen gift card(s). No responsibility is assumed by the Contest Sponsors for any delivery returned as undeliverable without a forwarding address. No responsibility is assumed by Contest Sponsors for any Prize after it has been shipped. Unclaimed Prize(s) will not be awarded. Any Finalist who conducts themselves in a manner or makes statements that would negatively impact the reputation of Sobeys and in particular its grocery store banner FreshCo will forfeit the award of any of the prizes.
11.To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, mathematical skill-testing question posed by telephone at a mutually convenient time and may also need to return a signed release of liability and acknowledgment form. Contest judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
12.By entering this Contest, entrants consent to the use of their entry, name, city of residence and/or any photograph of or that may be taken in publicity carried out by Contest Sponsors and their advertising agencies, without further notice or compensation.
13.This Contest is open to residents of Ontario who are over the age of majority, excluding employees of City, Sobeys, and their respective parent and affiliated companies, representatives, dealers, franchisees and agents, Contest suppliers and judges, and those with whom they are domiciled. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.
14. No communications will be entered into except with selected entrants.
15.The Contest Sponsors take no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. The Contest Sponsors are not responsible for any errors or omissions in printing or advertising this Contest. All entries become the property of the Contest Sponsors and will not be returned.The Contest Sponsors are collecting, using and disclosing personal data about entrants for the purpose of administering this Contest. No further informational or marketing communications will be received by entrants unless entrants provide the Contest Sponsors with explicit permission to do so as indicated on the entry form (please see City’s Privacy Policy at http://www.rogerspublishing.ca/privacy.shtml). Entrants may chose on the entry form to provide their personal information to Sobeys, to be used and disclosed for the purposes set out on the entry form (please see FreshCo’s Privacy Policy at http://www.freshco.com/Privacy.aspx )
16.Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release. By accepting a prize, winners consent to the Released Parties use of their name, place of residence, voice, statements, photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.
17.By participating in the Contest, and as a condition of acceptance of any Prize, each entrant, his/her heirs, executors, administrators, successors and assigns, RELEASES AND FOREVER DISCHARGES AND HOLDS HARMLESS Sobeys Capital Incorporated and Rogers Broadcasting Limited, their direct and indirect parent companies, affiliates, subsidiaries, successors, assigns, agents, advisors, franchisees, shareholders, partners, representatives, their advertising, promotion and fulfillment agencies and each of their respective employees, officers, directors, agents and representatives (collectively, the “Released Parties”), from and against any and all losses, damages (including, without limitation, direct, indirect, incidental, consequential or punitive damages), rights, claims, actions, causes of action, personal injury, property damage or death, including without limitation all costs and liabilities of any kind including solicitor fees, hereinafter called “Claims” AND INCLUDING WITHOUT LIMITATION ANY SUCH CLAIMS ARISING FROM ANY ACT OF NEGLIGENCE of the Released Parties, that the entrant now has, or may hereafter have against the Released Parties directly or indirectly resulting or arising from: (i) participation in the Contest, or the awarding, acceptance, possession,. use, or misuse or enjoyment of any Prize, or traveling to, preparing for, or participating in any Contest-related or Prize-related Event or activity; or (ii) the publicity rights granted to the Contest Sponsors. It is understood by the entrant that there may be serious risks of bodily injury, death, or property damage associated with the acceptance, possession, use and/or misuse of the Prize and attendance at any Event and the Prize winner voluntarily assumes these risks. The entrant also agrees to indemnify, defend, and hold harmless the Contest Entities from any and all Claims in respect of the foregoing.
18.This Contest will be run in accordance with these rules, subject to amendment by the Contest Sponsors. Entrants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
19.The Contest Sponsors assume no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. The Contest Sponsors reserve the right, in their sole discretion, to cancel or suspend this Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. In the event of cancellation, The Contest Sponsors may, in their sole discretion, elect to identify winners and award the prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
20.If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).
21.All issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, or the rights and obligations of the entrant and the Contest Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Province of Ontario, without giving effect to any choice of law or conflict of law rules (whether of the Province of Ontario or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
